Comments to the 'World Anti-doping code E-version 1.0' July 18, 2002 Kaz Shimada, M.D. /Japanese delegate to FAI-CIMP shimada.kazuhito@nasda.go.jp 1. (Article 1) Sport is for character$B!D(B for young people to develop the values$B!D(B -> Because Sky Sports regulated by FAI contains such sports in which senior participants are majority, it is not desirable to specify that sports participants are young people. 2. (Article 1) Sport is for community$B!D(B.In every part of the world young people, their parents and coaches, volunteers$B!D(B -> (same comment as in #1) Specifying that athletes/participants are young does not apply to Sky Sports. 3. (8.1.2) No statute of Limitation. -> It is doubtful if all Stakeholders can be covered by this clause, due to different legal systems among countries. 4. (8.2.1) Burden of Proof$B!D(B.This burden shall be greater than a mere balance of probabilities but less than a standard which may be expressed as proof beyond a reasonable doubt. -> This looks like a sentence made by British-American lawyer. Intent of this sentence is not clear to non-lawyer officials in other regions who are not familiar with British-American system. 5. (8.4.3) Ownership of Samples/Research -> It is not clear if the word 'research' used in 8.4.3 means the same as the word 'research' is used in Article 7. 6. (8.4.3) However, no specimen may be used for research without the athlete's express written consent unless all markings on the sample which identify the sample as coming from a particular athlete are removed. -> Even when the labels are randomized or kept secret, it is not allowed to be used for a research without participants' written consent. -> Also it is not clear which Institutional Review Board grants a research plan. 7. (8.5.3) and (8.6.1) 'B sample' Here a term 'B sample' is used without definition. It should be defined in Appendix 1. Otherwise a reader of this document cannot know if the procedure here takes two samples or three samples, or if 'A sample' and 'B sample' come from the same bolus or come from two separate sampling. (Comment per FAI Sporting Code) (8.8.2) States that FAI Sporting Code should have a disposition of a team of which one member is found to have a violation. CIMP should advise FAI to furnish this in the Sporting Code. (I might have missed a recent revision in the Sporting Code, though.)
